General Terms and Conditions (GTC) – Grace St. Moritz GmbH

1. Scope of Application

These General Terms and Conditions (hereinafter “GTC”) apply to all bookings, orders and services of Grace St. Moritz GmbH, Via Serlas 5, 7500 St. Moritz (hereinafter “Grace St. Moritz”).


1.2
Deviating contractual conditions shall only apply if expressly confirmed in writing by Grace St. Moritz.

These GTC supplement the GTC for “Events and Group Reservations” as well as the GTC for “Online Bookings.” In the event of a conflict, the more specific GTC shall prevail.

For readability, the masculine form is used; it applies equally to all genders.

Contract languages are German and English.


2. Offer and Conclusion of Contract


2.1
The presentation of services does not constitute a binding offer but rather an invitation to make a booking or order.


2.2
The contract is concluded upon written confirmation by Grace St. Moritz. If a booking is made for third parties, the person making the booking is jointly and severally liable with the contractual partner.


2.3
Room reservations become binding only upon receipt of a written confirmation (usually by email).


2.4
Restaurant, spa and other bookings may also be binding verbally; a written confirmation will be provided upon request.


3. Hotel Bookings

3.1 Prices
All prices are quoted in CHF including VAT and service charges. Included are buffet breakfast, spa access, use of public transportation in the Engadin Mobil area, and in summer, cable cars (without ski operation).


3.2 Payment Methods
Accepted payment methods: cash, Maestro, Visa, MasterCard, American Express, TWINT. Other digital payment methods may be accepted depending on availability.


3.3 Check-in / Check-out
Check-in from 3:00 p.m., check-out by 12:00 noon. Late check-out is subject to availability and may incur an extra charge.


3.4 Guarantee & Prepayment
After expiry of the cancellation deadline, full payment of the accommodation is due. Following booking confirmation, Grace St. Moritz may require an additional prepayment of up to 100% of the total price. Prepayments will be credited against the final invoice.


3.5 Cancellation by the Guest
Up to 3 days prior to arrival, 3:00 p.m.: free of charge
High Season Winter (Dec.–Apr.): up to 7 days prior
High Season Summer (Jul.–Sep.): up to 3 days prior
Sports Holidays (February): up to 28 days prior
Festive Season (Christmas/New Year): up to 60 days prior
Later cancellations or no-shows will be charged at 100% of the booked stay. Different conditions may apply depending on the booked rate. Prepayments already made are non-refundable.


3.6 Spa & Restaurant Bookings
Cancellations up to 24 hours prior are free of charge. Later cancellations or no-shows may be charged at 100%.


3.7 Compensation
Non-contractual use (e.g. late arrival, early departure, no-show) may result in compensation claims.


3.8 Cancellations by the Hotel / Overbooking
Grace St. Moritz reserves the right to cancel confirmed bookings in exceptional cases. If cancellation occurs more than three months before the planned arrival, Grace St. Moritz is not obliged to provide alternative accommodation.

If cancellation occurs less than three months before arrival (e.g. due to overbooking or unforeseen circumstances), Grace St. Moritz will make every effort to arrange equivalent or higher category accommodation in St. Moritz. Any additional costs for accommodation and transport will be borne by Grace St. Moritz. Further claims by the guest are excluded.


4. Liability of the Hotel

4.1
The hotel is liable to the guest only for damages caused intentionally or by gross negligence, and only as a direct result of a failure to perform or significantly inadequate performance of contractual obligations. Liability is in any case limited to the amount of the accommodation booked or actually paid by the guest at departure (excluding VAT and cash withdrawals).


4.2
If disruptions or defects occur in the hotel’s services, the hotel will endeavor to remedy the situation upon becoming aware of it or upon immediate notification by the guest. The guest is obliged to contribute reasonably to remedying the disruption, minimizing possible damage, and to report any defects immediately.


4.3
The hotel is only liable for loss or damage to items brought onto the premises in cases of intent or gross negligence. Where the hotel is legally responsible for third parties, liability applies only if gross negligence is proven. Liability is excluded if the third party caused the damage intentionally.


4.4
The hotel’s liability is expressly limited to the coverage of the hotel’s liability insurance. Any further liability is excluded. Liability for valuables and cash exists only if stored in the in-room safe or deposited at reception against receipt, up to a maximum of CHF 50,000 per incident. The hotel is not liable for damages arising from force majeure.


4.5
Any claims lapse if the guest does not notify the hotel in writing immediately after becoming aware of loss, destruction, or damage.


4.6
The hotel is not liable for the loss or damage of vehicles parked or maneuvered on hotel premises or their contents, except in cases of intent or gross negligence.


4.7
Messages, mail and goods for guests are handled with care. The hotel undertakes delivery, safekeeping, and forwarding (on request, at a charge). Claims for damages not based on gross negligence or intent, as well as indirect or consequential damages, are excluded.


5. Orders of Goods & Vouchers

5.1 Delivery
Delivery after payment by post, collection at the hotel, or download (for vouchers). Guests are responsible for the secure handling of digital vouchers.


5.2 Prices & Payment Methods
Prices in CHF including VAT. Payment methods as per section 3.2.


5.3 Voucher Validity
Vouchers are valid for 2 years from full payment. Cash redemption is excluded. Redeemable in all Grace St. Moritz facilities, excluding Skiservice Corvatsch.


5.4 Returns / Refunds
Vouchers may be returned within 10 days for credit.
Unopened, faultless products may be returned within 10 days.
Manufacturing defects or incorrect deliveries will be replaced free of charge.


6. Restaurants and Bars

6.1 Scope and Contractual Partner
These GTC apply to the contractual relationship between the individual guest (hereinafter “guest” or “you”) and Grace St. Moritz GmbH (hereinafter “hotel” or “we”) in connection with restaurant and bar reservations. Individual guests are considered those with reservations up to 9 persons. Groups of 10 or more are subject to the GTC for events and group reservations.


6.2 Conclusion of Contract
The contract is generally concluded by verbal or electronic confirmation. By making a reservation, the guest acknowledges the GTC in force at the time. Other terms apply only if confirmed in writing by the hotel. If the guest requests services not offered by the hotel, the hotel acts solely as an intermediary. A third party making a reservation is jointly liable with the guest.


6.3 Services, Prices, No-Show, Invoicing
The hotel undertakes to hold the reserved table(s) and provide the agreed services. Tables will be held for 15 minutes after the confirmed time. Thereafter, the hotel may release them.
Some restaurants apply a no-show fee, communicated at the time of booking. This will be charged to the guest’s credit card if the reservation is not honored and not canceled at least 24 hours in advance.
For sittings with two seating times (e.g. 19:00 and 21:00), guests with the earlier seating must vacate the table on time.
Prices are quoted in CHF including VAT. Invoices must be settled by departure unless otherwise agreed. Invoices without a due date must be paid within 10 days. Default interest of 5% applies to late payments.


6.4 Withdrawal by the Hotel
The hotel may withdraw from the contract for good cause (e.g. force majeure or safety concerns). In such cases, the guest has no right to compensation.


6.5 Liability
The hotel is only liable for intent and gross negligence. Any further liability, particularly for slight negligence or auxiliary persons, is excluded. The hotel is not liable for loss or damage to vehicles, sports equipment, or personal belongings unless caused by intent or gross negligence. Claims must be made immediately. The hotel is not liable for services provided by subcontractors.


7. Data Protection

7.1 Data Collection & Use
Personal data is processed exclusively for handling bookings, orders, or interactive customer programs (e.g. CLUB5). Data is shared only when necessary for fulfillment.


7.2 CLUB5
CLUB5 is the exclusive loyalty program of Grace St. Moritz. Members receive a 5% kickback on in-house consumption (excluding Skiservice Corvatsch) for direct bookings (via our website, by phone, or by email). Bookings via third-party providers (e.g. OTAs) are excluded.

The calculation and crediting of the kickback are carried out automatically based on guest-provided data and valid booking information. Guests are obliged to immediately report any technical miscalculations or incorrect entries. Grace St. Moritz reserves the right to make corrections.

Personal data collected under CLUB5 is used exclusively for account management, processing of the kickback, and provision of personalized offers. Data is not shared with third parties. The CLUB5 terms and conditions apply in addition to these GTC.


7.3 Security
Grace St. Moritz applies appropriate technical and organizational measures (e.g. encryption) but cannot guarantee absolute security.

7.5 Data Correction & Minors
Guests may request correction or deletion of their data. Persons under 18 require parental or guardian consent to enter into contracts.


8. Amendments
Grace St. Moritz reserves the right to amend these GTC at any time. The version published at the time of booking applies.


9. Applicable Law & Jurisdiction
Swiss law applies. The place of jurisdiction is St. Moritz.
